Fair Jobs Code
Summary
The Fair Jobs Code is a Victorian Government overlay policy promoting labour standards in government procurement. It requires suppliers tendering for contracts valued at $1M or more (excl GST) to hold a pre-assessment certificate demonstrating compliance with employment, industrial relations, and workplace health and safety obligations. For high value contracts ($20M+), suppliers must also submit a Fair Jobs Code Plan.
Operative since 1 December 2022, with revisions effective 1 September 2024. Applies to all mandated Victorian Government departments and agencies (listed in Schedule 1).
Threshold Structure

| Significant business expansion grants ($500K+) | Certificate required for grant recipients |
Five Compliance Standards
Suppliers must demonstrate they:
- Comply with all applicable employment, industrial relations, and workplace health and safety laws
- Promote secure employment — prioritise direct, permanent engagement
- Foster cooperative relationships between employers, employees, and their representatives (including unions)
- Promote workplace equity and diversity
- Ensure supply chain compliance with the above standards
Applicable Legislation
Suppliers must comply with: - Fair Work Act 2009 (Cth) — national workplace relations - Occupational Health and Safety Act 2004 (Vic) — workplace health and safety - Wage Theft Act 2020 (Vic) — wage compliance - Labour Hire Licensing Act 2018 (Vic) — labour hire licensing - Long Service Benefits Portability Act 2018 (Vic) — portable long service
Pre-Assessment Certificate
- Valid for 2 years
- Assessed on compliance history over the past 3 years
- No application fee
- Publicly accessible register for agency verification
- Must be current at time of tender submission
Fair Jobs Code Plan (High Value Contracts)
Required for contracts $20M+ (excl GST). Plan must address: - Industrial relations commitments - Occupational health and safety commitments - Labour requirements and employment strategies - Ongoing reporting throughout contract term
